COPYRIGHT TERMS OF USE

Maxvet (A Division of Ashish Life Science Pvt Ltd) affiliates ("we, us, our") want each visitor to the Site ("you") to have a safe, pleasurable visit, so we have established the following terms and conditions so that we (we and you) know what to expect from each other. By using the Site you agree to be bound by the terms set forth herein. We may make changes to the Site, these Terms of Use, or the policies and conditions that govern the use of the Site at any time. We encourage you to review the Site and these terms periodically for any updates or changes. Your continued access or use of the Site shall be deemed your acceptance of these changes and the reasonableness of these standards for notice of changes.

We will communicate with you by e-mail or by posting notices on this site. PRICING INFORMATION

While MaxVet strives to provide accurate product and pricing information, pricing or typographical errors may occur. In the event that a product is listed at an incorrect price or with incorrect information due to an error in pricing or product information, MaxVet shall have the right, at our sole discretion, to refuse or cancel any orders placed for that product, unless the product has already been dispatched, in the event that an item is mis-priced, MaxVet may, at its discretion, either contact you for instructions or cancel your order and notify you of such cancellation. Unless the product ordered by you has been dispatched, your offer will not be deemed accepted and MaxVet will have the right to modify the price of the product and contact you for further instructions using the e-mail address provided by you. In the event that MaxVet accepts your order the same shall be debited to your credit card account and duly notify to you that the payment has been processed. The payment may be processed prior to MaxVet dispatch of the product that you have ordered. If we have to cancel the order after we have processed the payment, the said amount will be reversed back to you. All prices displayed on the website are inclusive of all taxes and subject to change without prior notice.

Order cancellation by MaxVet

We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being cancelled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our credit and fraud avoidance department. We will contact you if all or any portion of your order is cancelled or if additional information is required to accept your order. If your order is cancelled after your credit card has been charged, the said amount will be reversed back.

REFUND POLICY

‘The MaxVet reserves the right to cancel/reject any Order placed on its Shopping Cart without assigning any reason, subject to following circumstances:

* In case MaxVet is initiating the cancellation then 100% of the order value shall be refunded to the customer.

We at MaxVet will not be able to cancel orders that have already been processed and shipped out by us. Refunds in case of Credit/Debit cards will be normally processed by us within 30 working days. The refunded amount would reflect in the respective Cardholder’s Account as per the Cardholder's Card issuing Bank's policies.

CREDIT CARD

You agree, understand and confirm that the credit card details provided by you for availing of services on the website will be correct and accurate and you shall not use the credit card which does not lawfully belong to you i.e. in a credit card transaction, you must use your own credit card. You further agree and undertake to provide the correct and valid credit card details to the Paypal. Further the said information will not be utilized and shared by Maxvet with any third parties unless required by law, regulation or court order. Maxvet will not be liable for any credit card fraud. The liability for use of credit card fraudulently will solely be incurred by you and the onus to 'prove otherwise' shall exclusively rest upon you.

FRAUDULENT / DECLINED TRANSACTIONS

MaxVet reserves the right to recover the cost of goods, collection charges and lawyers fees from persons using the Site fraudulently. We also reserve the right to initiate legal proceedings against such persons for fraudulent use of the Site and any other unlawful acts or omissions in breach of these terms and conditions.

PROOF OF IDENTIFICATION

MaxVet reserves the right to ask for defined proof of identification at the time of delivery. Failure to provide the same to either MaxVet or any of its associates, can lead to cancellation of the order. Incase of any gift items, customer who has made the transaction online may have to provide his/her proof of identification.

DELIVERY TIME

Orders will be delivered within 7 - 14 working days subject to availability of the product.

IN AGREEMENT

1. MaxVet will be shipping the products to you at the address registered in your order.
2. MaxVet will not be held liable for any delay or loss of ordered shipment.
3. You also hereby agree to state that you will not instruct the Credit Card Companies or any other Monetary Transaction authorities advising them to obtain any refund from MaxVet due to delay or loss which is beyond their control.
4. In the event that a non-delivery occurs on account of a mistake by you (i.e. wrong name or address or any other wrong information) any extra cost incurred by the MaxVet for re-delivery shall be recovered from you.

YOUR CONDUCT

Any conduct by you that in our sole discretion restricts or inhibits any other user from using or enjoying the Site will not be permitted. You agree to use the Site only for lawful purposes. You are prohibited from posting on or transmitting through the Site any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, profane, hateful, fraudulent, racially, ethnically, or otherwise objectionable material of any kind, including but not limited to any material that encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable local, state, national, or international law. You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Site, use of the Site, or access to the Site. You agree not to access the Site by any means other than through the interface that is provided by us for use in accessing the Site.

OUR RIGHTS

We may elect to electronically monitor areas of the Site and may disclose any Content, records, or electronic communication of any kind (i) to satisfy any law, regulation, or government request; (ii) if such disclosure is necessary or appropriate to operate the Site; or (iii) to protect our rights or property or the rights of the users, Sponsors, Providers, Licensors, or Merchants. If notified of allegedly infringing, defamatory, damaging, illegal, or offensive Content, we may investigate the allegation and determine in our sole discretion whether to remove or request the removal of such Content from the Site. We may terminate your access, or suspend your access to all or part of the Site, without notice, for any conduct that we, in our sole discretion, believe is in violation of any applicable law or is harmful to the interests of another user, a third-party Provider, Merchant, Sponsor, Licensor, service provider, or us. We are not responsible if goods are unclaimed within 60 days from the date of sale. Thereafter, the customer shall not be entitled for the goods and amount shall stand forfeited to the company.

SUBMISSIONS

You may post reviews of products or services, comments, suggestions, or other material ("Submissions") so long as the content of your Submission is not unlawful, threatening, abusive, spiteful, defamatory, invasive of privacy, obscene, profane, sexually explicit, fraudulent or otherwise objectionable or injurious to third parties (including, but not limited to, any content that encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate applicable law). By sending us any Submission, you grant MaxVet and its subsidiaries a non-exclusive, royalty-free, perpetual, and irrevocable and fully sub licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such Submission throughout the world in any media. You also grant MaxVet the right to use the name you submit in connection with such Submission.. You agree to indemnify MaxVet, and its subsidiaries against all claims and liabilities resulting from your Submission. MaxVet does not take any responsibility and assumes no liability for any Submission posted by you or any other person or entity.

APPLICABLE LAW

We control the Site from our office in India. We make no representation that the Content in the Site is appropriate or available for use in other locations, and access to them from territories where their content is illegal is prohibited. Those who choose to access the Site from other locations do so on their own initiative and are responsible for compliance with applicable local laws. You may not use or export the Content in violation of Indian export laws and regulations. Any claim relating to the Site, the services provided through the Site or the internal laws of Indian Jurisdiction shall govern the Content, without reference to its choice of law provisions. You hereby irrevocably consent to the exclusive jurisdiction and venue of courts in Mumbai, India.

TERMINATION
